10-Year Limited Warranty
Congratulations on your purchase of a new Piana Sleep mattress (the “Product”). Piana Sleep is proud to offer innovative sustainable sleep products that provide you with incredible comfort, quality, and security, while we care for the environment and the well-being of you and your family. We stand behind each Piana Sleep Mattress with a limited warranty, the terms of which are set forth below.
Your Limited Warranty
Subject to the Limitations and Exclusions from Coverage set forth below, Piana Sleep provides you, as the original retail purchaser of the Product, the following limited warranty:
During the ten (10) year period from the date of original retail sale to you, Piana Sleep will, at its sole option and as your exclusive remedy, replace or repair the Product at no cost to you (except for transportation and delivery costs, which shall be your sole responsibility) if Piana Sleep finds, following its reasonable inspection, defects in workmanship and/or materials in the Product (except and not including the mattress fabric and any handles attached to the Product).
Limitations
This warranty is limited to the any visible indentation equal to or greater than one inch (1”) in depth. If Piana Sleep approves the warranty claims, and the materials used in the original manufacture of the Product are not reasonably available, Piana Sleep reserves the right to substitute materials of comparable quality. The Product MUST always be used in conjunction with a rigid, firm, non-yielding foundation and with a rigid center support that extends to the floor for queen and king sizes, an adjustable base, a Piana Sleep foundation, or similar hard surface(s), which guarantee adequate center support and aeration.
If you’re using a foundation, ensure your frame offers robust center support and support for the head, foot, and sides. For queen or king frames lacking a metal center support, use a minimum of 5 hardwood or metal slats (1″ x 4″) and attach legs to the 3 center slats. Failing to provide a sturdy frame may lead to product damage, invalidating your warranty.
When not using a foundation (e.g., with a platform bed), place a solid platform on top of any slatted mattress support system with gaps larger than 2 inches (5 centimeters) between slats. Use materials like hardboard, plywood, or particle board between the mattress and slatted platform to fully support the mattress surface. Using an open slatted system without a solid platform will damage your mattress and void your warranty.
This limited warranty is effective for purchases of Product sold in North America on or after January 1, 2022. This limited warranty is provided only to you, as the original retail purchaser, and is not transferable or assignable.
Exclusions
This limited warranty shall NOT apply in the following circumstances:
- Normal wear and tear of the Product;
- If the Product is used without a proper foundation and/or inadequate center support;
- If the Product is found to be unsanitary, dampened, burned, cut, stained, and/or soiled;
- If the Product was exposed to hot or cold temperatures, wet environments, or inappropriate climate conditions, including, but not limited to, rain and humidity;
- Defects or damage to the Product resulting from accident, misuse, abuse, neglect, unusual physical stress, alteration, improper operation, and/or maintenance;
- If the Product has any damage to the outer fabric of the cover;
- Discoloration and/or other cosmetic changes;
- If the Product was repaired by third parties not authorized by Piana Sleep;
- Product failure not caused by defects in workmanship or material; and/or
- If the Product was sold “as is,” as a floor sample, and/or purchased from second-hand parties, non-retail establishments, or received as a promotional item.
Further, this limited warranty shall not apply to:
- Body impressions, which are a normal occurrence in a Product and indicate that the upholstery layers are performing as they were designed to do by conforming to the body’s individual contours. Such compressions are natural and are not structural or design defects, and therefore are NOT covered by the limited warranty;
- Indentation NOT greater than one inch (1”) in depth;
- A normal change in the comfort of the Product which does not affect its pressure-relieving qualities;
- Handles, if present on the Product;
- Product height;
- Comfort preference;
- Product purchases from unauthorized sellers, distributors, retailers, and/or dealers;
- If you, as the original retail purchaser, do not present proof of purchase which shows date, place, and price of purchase of the Product;
- Pillows, toppers, and other products not identified in this limited warranty; and/or
- Transportation and inspection costs.
Disclaimers
The 10-year limited warranty set forth in this document is your exclusive remedy and the only express warranty applicable to the product sold within North America, and no one is authorized to modify or expand this limited warranty.
The foregoing limited warranty shall not exceed in duration the term set forth herein and is in lieu of all other warranties or conditions. Piana sleep makes no additional warranties or conditions, express or implied, as to the product, including any warranties of merchantability or fitness for a particular purpose, which are hereby expressly excluded and disclaimed, nor does Piana sleep warrant that the product does not infringe upon the patent, copyright, or trademark of any third party. Piana sleep expressly excludes and disclaims, and it shall not be liable for, any indirect, incidental, consequential and/or exemplary (punitive) damages arising out of the sale or use of this product, and in no event shall Piana sleep’s liability exceed the purchase price of the product.
Some States do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This limited warranty gives you specific legal rights. You may also have other rights, which vary from State to State.
How to request service under this limited warranty
- Contact the authorized retailer from whom you purchased the Product. If your authorized retailer is unavailable, contact Piana Sleep at the address below.
- Send to the authorized retailer and/or Piana Sleep copies of the following documents:
- Proof of the Product’s purchase, which shows the date, location, and price; and
- Copy of the law tag label.
